Allegations

Violations of the Truth-in-Leasing regulations by failing to properly set forth and abide by compensation schedules; misuse of escrow funds; unlawful charge-backs for fuel and fuel-related transaction fees; unlawful charge backs for insurance-related administration fees.

The court held a hearing on June 4, 2007, to determine whether to grant final approval to the proposed settlement and to award attorneys’ fees and expenses.  The judge stated the settlement amount of $6.25 million was fair and adequate and that the settlement represented a substantial recovery on behalf of the class.  The court also awarded attorneys’ fees in the amount of $2.08 million or 33 percent of the settlement fund.  Finally, the court approved incentive awards in amounts varying between $10,000 and $15,000 for each of the seven individual named plaintiffs.  We received the money by July 19, 2007 (as required) and distributed the money to the class members in August 2007.
