Allegations

The Ontario Court dismissed the charges against OOIDA member, Mr. Gene Michaud, in connection with the Ontario speed limiter law. The Court ruled that the Ontario law violated Mr. Michauds rights under the Canadian Charter of Rights and Freedoms, specifically the right to security of the person.

The Crown filed a notice of appeal on June 28, 2012 which was heard on September 17, 2013.

On December 20, 2013, the Judge considering the case asked counsel for both sides to make further submissions related to a recent Supreme Court of Canada (SCC) case, the lower court decision of which we relied on in our case.

The matter was in court on February 24, 2014. The appeal judge asked for further submissions and indicated he would deliver his decision in court on May 15, 2014.

The Supreme Court of Canada dismissed the application. No reasons were given.
