Allegations

OOIDA alleges that the FMCSR’s have never authorized performance based Out of Service orders for fatigue and that Anne Ferro’s letter of October 23, 2012 (attached to Petition to Review (below)) to Jim Johnston was an unlawful attempt to amend the regulations to authorize such Out of Service orders without notice and comment rule making.

The Court recently issued an order to dismiss OOIDA’s petition for Review on January 22, 2014, stating that the court does not have the authority to review the case.
